Terms of Use

1. Scope

These terms apply to the website inkday-neon.vercel.app and the Inkday iOS app. The operator is Fabian Gruß, trading as Fabian Gruß Digital Solutions; see the legal notice.

2. The app

Inkday is a private voice diary for iPhone (iOS 26 or later). You speak one page a day. Recording, transcription and storage happen on the device. There is no account and no developer cloud.

Inkday is not a medical, therapeutic or diagnostic product and not a habit tracker.

3. The website

This site describes the product. It sets no cookies and loads no analytics scripts.

4. App Store contract

You download the app and buy In-App Purchases from Apple, not from us. Apple’s terms apply, including the Apple Media Services Terms and the Licensed Application End User License Agreement.

We grant you a simple, non-transferable licence to use Inkday on devices associated with your Apple ID, subject to Apple’s terms and these terms.

5. Price and what you get

Recording and reading the last 30 days is free. There are no ads and no subscription.

Pages older than 30 days stay on the device but stay locked until a one-time non-consumable In-App Purchase. The price shown in the App Store is binding and may vary by storefront.

Nothing is deleted — only locked. Restore Purchase in Settings restores the same unlock via your Apple ID.

6. Payment, withdrawal, refunds

Payment, invoices and refunds are handled by Apple. Request a refund or withdrawal for an In-App Purchase from Apple, not from us. Mandatory consumer rights remain unaffected.

7. Your content

Recordings, transcripts and mood choices are yours. We do not receive them. You are responsible for creating that content lawfully.

Deleting a page removes its text and audio on the device. Deleting the app removes remaining local Inkday data on that iPhone. An iPhone backup (including iCloud Backup) may include local app data — you control that in iOS Settings.

8. Availability

Transcription and mood suggestions use Apple frameworks on the device. They can vary by device, language and iOS version. We do not promise uninterrupted availability of Apple services.

9. Liability

We are fully liable for intent and gross negligence, for injury to life, body or health, under product-liability law, and where a guarantee was given.

For slight negligence we are liable only for breach of essential contractual duties, and only for typical, foreseeable damage.

Otherwise liability is excluded, including for persons we use to perform the contract. Mandatory consumer protections in your country of residence remain unaffected.

10. Changes

We may update these terms when features, the law or how the product is provided change. The current version is on this page. Apple’s terms in force at the time of a purchase remain decisive for that purchase.

11. Governing law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection rules of your country of habitual residence remain unaffected. If a provision is invalid, the rest stays in force.
